New Restrictions on Florida HOAs Effective July 1

Starting July 1, a new law in Florida restricts homeowner associations (HOAs) from imposing certain regulations on homeowners. This marks a significant change for many residents who have faced stringent HOA rules.

Key Changes in HOA Regulations

Homeowner associations have historically been established to maintain community standards, collect dues for shared services, and oversee neighborhood improvements. 

However, many homeowners have experienced issues such as arbitrary fines, excessive restrictions on property appearance, and a lack of transparency.

HB 1203: Homeowners' Bill of Rights

The new legislation, HB 1203, dubbed the Homeowners' Bill of Rights, aims to curb HOA overreach. This law follows recent measures allowing homeowners to reinforce their homes against hurricanes without HOA interference.

Training and Conduct for HOA Leaders

HOA directors and managers are now required to undergo training on various aspects of HOA management, including financial literacy and transparency. Soliciting or accepting bribes is classified as a third-degree felony.

Enhanced Management Oversight

HOA managers must attend at least one annual meeting and provide contact information and availability on the HOA’s website. Contracts between HOAs and management firms must be readily accessible to homeowners.
